  • Can “second-hand” books and other digital works such as downloaded audio-books and music be resold? In recent years this question has repeatedly proved to be controversial. After the Higher Regional Courts (OLG) in Stuttgart and Hamm, OLG Hamburg recently debated the question whether the exhaustion principle also applies where digital works are concerned. In particular, the court in Hamburg had to decide whether the considerations of the Court of Justice of the European Union (CJEU) in UsedSoft1 on the resale of downloaded software can be applied to other digital works such as e-books and music downloads. The OLG Hamburg answered both questions in the negative in its decision of 24 March 2015.2 Correspondingly, a clause in the standard terms and conditions prohibiting the resale of such digital works is valid. Despite the clarity of the arguments put forward by that court, it is apparently possible to take a different view, for only days after that judgment was handed down, the Dutch Rechtbank Den Haag referred the exact question of the exhaustion of digital works to the CJEU. Hence the debate continues.
