B CJEU links fair compensation in Articles 5(2)(a) and (b) of the InfoSoc Directive to actual harm requirement Hewlett-Packard Belgium SPRL v Reprobel SCRL, Epson Europe BV intervening, C-572/13, EU:C:2015:750 In its decision on 12 November 2015 in Hewlett-Packard v Reprobel (Reprobel), the Court of Justice of the European Union (CJEU) held that in relation to the exceptions or limitations in Articles 5(2)(a) and (b) of Directive 2001/29/EC (the InfoSoc Directive): (1) a distinction must be made depending on the user of a multifunction device, because the amount of fair compensation depends on the actual harm suffered; (2) publishers should not be entitled to any fair compensation because they do not suffer any harm; (3) sheet music is excluded from Articles 5(2)(a)and (b), and reproductions from unlawful sources are not allowed under EU law; and (4) a national law that provides for ex ante lump sum remuneration that only takes into account copying speed is incompatible with EU law, although a combined levy system is not necessarily incompatible per se.
