  • Geographical data that are extracted from a topographical map by a third party in order to produce and market another map constitute independent elements of a database within the meaning of Sec. 87(a)(1), first sentence, of the Copyright Act, because they provide the customers of the enterprise using the data after their extraction with pertinent information. The intended purpose of topographical maps and the use the typical user can be expected to make of them are not relevant when it comes to assessing the independence of the elements.
