Passing verdict at the end of April, the Luxembourg-based court ruled that the Barcelona players fame counteracts the visual and phonetic similarities between his mark and the mark Massi belonging to a Spanish bicycle producer. The court added that while the signs are similar phonetically, the European Union Intellectual Property Office (EUIPO) erred in its conceptual comparison of the signs by holding the marks would cause consumer confusion.
