  • The European Court of Justice (CJEU) has been addressing the communication to the public (CTP) right in EU copyright law for more than 10 years. Over that time, it considered cases with diverse facts, and while its definition of the concept has evolved with each new case, its decisions continue to be highly fact specific, missing the opportunity to provide a coherent overarching doctrine to underlie CTP. The Advocate General Campos Sánchez-Bordona’s (AG) opinion in the latest CTP case, Land Nordrhein-Westfalen v Dirk Renckhoff (C-161/17) confirms this fact-specific approach and introduces specific criteria for a non-commercial educational use of a copyright work.
