Passing decision in Cobbler Nevada v Thomas Gonzales, Circuit Judge Margaret McKeown ruled that the sole allegation that a defendant is the registered subscriber of an IP address associated with infringing activity is insufficient to state a claim for direct or contributory infringement. Affirming a US District Court of Oregon verdict, the circuit added that the lower court did not abuse its discretion in awarding attorneys fees to the defendant.
