  • The video game Fortnite has spawned dances or ‘emotes’ and a test for the Copyright Act. The floss; the hype; the fresh. These dances, or ‘emotes’ have taken social media by storm due in large part to their presence in the record-breaking video game Fortnite, which boasts over 200m players as of 2018.1 However, the creators of these dances have sued the game’s developer (Epic Games) for using them in the game without permission or compensation. The lawsuits assert copyright infringement, among other causes of action. But are these emotes protectable under US copyright law?
