  • The global marketplace created by the internet poses a unique challenge to trademark owners in restraining infringement. However, the territorial nature of trademarks means that it will not always be possible to enforce against trademark infringement on every website. A recent High Court case provides a good summary of the factors to consider in determining whether a trademark which appears on a website is ‘used’ in the UK for the purposes of trademark infringement.
