  • On 4 March 2019, SCOTUS rendered a unanimous decision in Rimini Street v Oracle USA, determining that prevailing parties in copyright litigation may not recover litigation costs beyond those explicitly identified in the general cost statutes, codified at 28 USC §§1821 and 1920.1 Accordingly, the court reversed the Court of Appeals for the Ninth Circuit decision to award ¤12.8m in costs to Oracle USA for electronic discovery expenses, expert fees, and jury consultant expenses, and remanded the costs issue to the Ninth Circuit for further proceedings consistent with the court’s opinion.
