The legal protection of expressions of folklore has been a topic of international discussion for several decades. 1 The terminology, in legal parlance, has evolved from a general concept of folklore into a protection of traditional cultural expressions (TCEs). 2 There is a widespread understanding among legal scholars that the cultural heritage of indigenous people deserves at least some form of legal protection. 3 However, a persistent question has been whether existing IP regimes are applicable and desirable legal instruments for this purpose. 4 Should the international community seek sui generis solutions instead and should these tailored solutions be legally binding? In view of the difficulty of arriving at an international treaty (or even non-binding instruments), a regional approach has been proposed
