  • During the period from May 2015 and until August 2017, and in the then still applicable two-tier court system in Iceland, the district courts decided in five court cases concerning copyright, whereas the Supreme Court of Iceland handed down judgments in four such cases. When Iceland separated from Denmark in 1918 one of the stipulations was that the highest court in Icelandic matters could be established in Iceland, and Iceland used that stipulation when the Supreme Court of Iceland was formed in 1920, replacing the Supreme Court of Denmark. However, only a two-tier system was in place in Iceland after that, apparantly as decisions of the Icelandic appeal court were seldom appealed to the Supreme Court of Denmark. A new court level was introduced in Iceland in 2018, and therefore a a three-tier court system is back in place in Iceland. The new court is called the Court of Appeal (Landsréttur) and is a court of second instance. The Court of Appeal has already handed down judgments in copyright case, which will reflect in future overviews of this kind. Icelandic copyright experts await to see how the court will fair on expertise and what influence it will have in this field of law. During the period, Iceland also saw four material revisions to the Copyright Act No. 73/1972, which is a retively high number of revisions in comparision to earlier amendments. The most extensive revision being with Act No. 9/2016 which concerned inter alia extended collective licenses.
