The EU-wide protection for both registered and unregistered designs that has been routinely relied on by many companies and designers over the years no longer covers the UK. Steps were taken to ensure there was no loss of rights when EU law ceased to apply in the UK. However, as protection for designs is linked to their novelty there are important nuances to consider and build into protection strategies.
