However, in many instances such use occurs without permission from the performer or the copyright owner. This piece is the first in a two-part article examining recent decisions in this area from courts in New Zealand and Australia. These cases—Eight Mile Style LLC v New Zealand National Party, on appeal in The New Zealand National Party v Eight Mile Style LLC and Universal Music Publishing Pty Ltd v Palmer (No.2)—highlight the expensive consequences of unlicensed use of copyright-protected songs for political purposes.
