  • Ukraine’s law ‘On Restriction of Monopoly and Prevention of Unfair Competition in Entrepreneurial Activity’ was the first Ukrainian law on competition. It was adopted in 1992 and aimed at the ‘elimination of monopolization’. From 2000, the emphasis of antitrust and competition policy shifted from restricting monopoly power in the economy to the development and protection of real competition. The Law of Ukraine ‘On the Protection of Economic Competition (LPEC)’ entered into force in 2002 and is based on the principles of EU competition law. Today, domestic competition policy continues to focus on measures to liberalize economic sectors that are in a state of natural monopoly while improving legal mechanisms for regulating the activities of natural monopolies and mechanisms to protect real and potential competition. Ratified in September 2014, the EU-Ukraine Association Agreement (hereinafter ‘AA’ or ‘Association Agreement’) specifies in its preamble that the adoption of the AA contributes to the gradual economic integration and deepening of political association between the parties. The Association Agreement may have a significant effect on the application of national competition rules. It is notable that the AA covers very strict and specific provisions in the field of competition. It can therefore be inferred that the ‘Europeanization’ of competition law alongside commitments to implement competition acquis – in particular case law – within the Ukrainian legal order is underway. This is evidenced by the fact that the AA also provides for an effective competitive environment within the established free-trade area (Arts. 253-267) and reproduces the regulations of the EU law and contains provisions strictly referring to the regulations.
