  • On 3 November 2021, the Royal Decree Law which transposed, among other directives, Directive 2019/790 on copyright and related rights in the digital single market (hereinafter the ‘DSM Directive’) was published in the Official State Gazette (BOE). Minutes later, the general manager of Google Spain posted, in a company blog, the return of Google News at the beginning of 2022. What happened that would move Google News to announce its return to Spain? By surprise and at the last minute, in a Bill presented by the Spanish Government to Parliament, Law 21/2014 of 4 November introduced a new limit for online content providers which allows them, without authorisation, to link to ‘insignificant fragments of content, disseminated in periodical publications or on regularly updated websites and which have an informative, public opinion-forming or entertainment purpose’. In practice, internet news aggregators allow users to view significant excerpts of press content, which means that they are often no longer interested in visiting the original link. This behaviour has led to a significant reduction in traffic on the original medium and thus to a sharp drop in revenues. For this reason, and to compensate for these effects, the new limitation was linked to the payment of a remuneration for the benefit of press publishers and other right holders. The problem, however, arose because the right to remuneration took the form of an unwaivable right to a reasonable compensation mandatorily subject to collective management. Thus, from its very entry into force, this limit prevented right holders from both prohibiting and reaching agreements on their own regarding the use of their content with news aggregators. The debate that accompanied the parliamentary processing of the limitation was heated, even leading to a negative report by the National Commission for Markets and Competition. Nevertheless, it was finally approved, provoking not only the exit of Google News from Spain before the reform entered into force, but also, in a way, its victory, as was evidenced by an approximate 30% reduction in online traffic on the websites of press publishers, especially smaller ones, after its exit.
