Huomautus sisällöstä, tiivistelmä tms. The relationship between originality and novelty is a classic issue in intellectual property. The first concept comes from the tradition of literary and artistic property – copyright law to be specific. The second comes from the arena of industrial property, design law specifically. The protection afforded by copyright law differs in many respects from protection under design law and in fact, each doctrine pursues fundamentally different objectives. Copyright law protects the originality of an intellectual work incorporating “attributes of an intellectual and moral nature as well as attributes of a pecuniary nature”. Design law protects the appearance of a manufactured or handcrafted product, the purpose being to protect the investment made.
