  • The enforcement of intellectual property rights (IPRs) provides for the protection of the rights and interests of IPR holders in a legal procedure, where a natural or a legal person infringes these rights. Enforcement of IPRs is achieved by administrative and civil measures, as well as by criminal sanctions in appropriate cases. Directive 2004/48/EC on the enforcement of IPRs (Enforcement Directive)1 provides for a set of measures, procedures and remedies allowing for effective civil enforcement of IPRs. This applies to any infringement of IPRs as provided for by Union law and/or by the national law of the Member State concerned. While the Enforcement Directive does not provide a list of specific rights which are considered IPRs for its purposes, Recital 13 explains that its scope should be defined as widely as possible to encompass all the IPRs covered by the provisions of EU law in this field and/or by the national laws of the Member States. In 2005, the Commission issued the non-legally binding Statement 103 on Article 2 of the Enforcement Directive to help clarify its scope. Geographical indications (GIs) are listed among the IPRs covered by the said Directive.2 However, GIs do not confer individual rights (such as other IPRs) but rather ‘collective rights’ and, once protected, the exclusive right to use the GI belongs to all producers in a given geographical area who comply with the specific conditions for the production of the product.
