  • The legal position on the protectability of product packaging as a trade mark varies from one jurisdiction to another. While some jurisdictions such as China are still reluctant to protect packaging and three-dimensional trade marks in general, this is not the case in Europe. Article 3 of the European Union (EU) Trade Mark Directive explicitly mentions the protection of packaging in its enumerative list of protectable signs. Offering a comparative perspective, this article considers both English and German trade mark law to point out that, even though product packaging is protectable subject matter, the definition of a trade mark nevertheless impacts on the extent to which product packaging enjoys trade mark protection. The article begins by briefly examining the functions and necessity of product packaging (II). It then moves on to consider the protectability of product packaging as a trade mark in English law and observes that, prior to European trade mark harmonization, discussion in the UK of the registrability of product packaging as a trade mark focused on whether product packaging should be protectable subject matter rather than on whether product packaging could be distinctive (III). Next, the article considers the legal situation in Germany and asserts that the protection of product packaging as a shape mark is sometimes opaque and can lead to considerable practical difficulties (IV). Finally, protection options beyond trade mark law are considered (V).
