  • On 16 September 2021, China announced its application to join the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP, the Agreement) of 30 December 2018, which suspended certain provisions of the Trans-Pacific Partnership (the original version of the Agreement). China’s application to join the CPTPP has prompted debates over the compatibility of China’s domestic legal system with the CPTPP’s high standards, especially as trade mark and copyright infringements are pervasive in China and IP law enforcement remains a challenge.1 Very few studies have compared the provisions of the CPTPP with the People’s Republic of China’s (PRC’s) IP regulations,2 and such studies fail to take into account the latest changes to the PRC’s laws. For example, these studies overlook to apply the systematic approach necessary to analyse the intensity of cross-class protection for unregistered, well-known trade marks, and they do not apply the necessary comparative approach to speculate on the duration of patent grace periods as restricted by the Agreement. This study addresses this gap in the literature.
