To Meme or Not to Meme : A Copyright Analysis of Memes in the Australian Context

  • Memes are a relatively modern form of communication that are considered by intellectual property law scholars to be transformative works because they borrow elements from pre-existing works to create a new form of communication, facilitating social discourse in the form of criticism and/or parody. Memes are inherently dynamic because they are altered, and their message changed as they are communicated through online platforms such as social media. Australian legal authorities have not considered the protection of memes under copyright law and this article attempts to provide academic commentary to facilitate discussion. To achieve this purpose, thi article first examines the concept of memes to provide and outline of the nature of this relatively new phenomenon. Second, te article explores the requirement for originality in the Australian copyright law context and analyses it in relation to memes. Finally, the author concludes that although memes may qualify for copyright protection, this may not be desirable from the perspective of the underpinning theories of copyright law and the very nature of memes that is to change as they are communicated. The article recommends that the Copyright Act 1968(Cth) be reformed and that exceptions such as a fair use defence be implemented to allow for the communication and adaptation of memes to support culture and social discourse.
