The general policy of European media regulation is largely determined by the objectives of the internal market, so as to ensure that the distribution and accessibility of broadcasting services in other Member States are not unduly impeded by differences in national law. Based on free movement of services, the key to this approach lies in the so-called country-of-origin principle: the media service provider should be subject only to the rules of the Member State where it has its head office. This principle is also known in European copyright, and is notably at the heart of Directive 93/83 on cable and satellite broadcasting services and facilitating the granting of rights for the cable retransmission of foreign radio or television channels. The same legal certainty is intended to be provided by the recent Directive 2019/789 on online broadcasting services and the retransmission of television and radio programmes, adopted on 17 April 2019, for online broadcasting services supporting television and radio boradcasts and for the retransmission of television and radio programmes via other platforms than cable. However, it is questionable whether the EU legislator has succeeded in this aim.
