This article first provides an overview of the background and functioning of different domain name dispute resolution procedures before providing tips and tricks for practitioners to make more efficient use of these procedures. These tips and tricks not only relate to the procedure itself but also to writing a clear and concise domain name complaint. This article is limited to alternative dispute resolution (ADR) procedures and will not discuss the case law of ordinary courts on domain names. The main focus of this article is the Uniform Domain Name Dispute Resolution Policy (UDRP), the world’s most important domain name dispute resolution policy. Given the background of the authors, who are based in the Netherlands, the UDRP is mainly compared to policies that play a role in Dutch, Benelux and European practice.
