A review of the recent judgment Shazam v Only Fools The Dining Experience [2022] EWHC 1379 (IPEC) in which the possibility of copyright subsisting in a character was assessed for the first time in an English court. The significance of the judgment and its interaction with European Union (EU) law are considered, in particular the application of the recent two-stage test for establishing protection of copyright works, as set out by the Court of Justice of the European Union in Cofemel. The limitations of the judgment and potential for future legal uncertainty are also evaluated.
