The performer and the phonogram producer have the right to equitable remuneration if a phonogram published for commercial purposes or its reproduction is used for communication to the public. 2. The amount of the equitable remuneration is not necessarily related to the legal form of the user, but the economic value of the use and the gain deriving from it. 3. The establishment of reasonable tariffs for exclusive rights and remuneration rights must also take into account the following circumstances: (1) the nature and scope of the use of the work and the objects of rights accompanying the copyright; (2) the economic value of the service provided by the collective management organization. 4. The right to receive equitable remuneration is different from the right to prohibit the communication of the phonogram s published for commercial purposes to the public. Therefore, it is not justified to require the right holders’ consent to use the phonogram s.
