Despite plagiarism being rife in the TV industry, owners and licensors of hit formats often shy away from court action, nervous of an adverse decision regarding what is protectable in law. In this article Rebecca Swindells and Micahel Sweeney of law firm, Field Fisher Waterhouse consider the recently issued High Court claim against the owners and producers of "The Only Way is Essex" ("TOWIE") alongside the wider disputes concerning television formats.
