South Africa's first constitutional court decision on copyright has profound implication for ongoing copyright reform and the development of norms at the intersection of human rights, disability and intellectual property rights. This commentary sets out the international framework, South African law and policy on disability rights, and the ongoing copyright reform process as background to the case. It then explains the basis on which the applicant secured a declaration of constitutional invalidity of sections of the Copyright Act due to the statute's failure to provide exceptions to enable access to literary works, inclusive of artistic works contained in them, for persons with visual and print disabilities, with a focus on the human rights arguments and findings. It concludes with a consideration of the practical effect of the outcome on the ongoing copyright reform process.
