  • According to the European Commission’s Circular Economy Action Plan, electronic devices need to be more durable, reusable, upgradeable and repairable. Although some enacted or proposed legislative changes are dealing with this issue, there remains the question of control over the aftermarkets for repair, upgrades and refur-bishment of electronic goods. Currently, different legislative measures adopt divergent approaches, either endorsing independent service providers or empowering manufacturers. In the context of the Commission’s plans, this article investigates the role of Article 5(1) Software Directive, which allows lawful acquirers of computer programs (including programs that are a ‘digital element’ of tangible goods) to repro-duce and modify such programs to the extent necessary to use them in accordance with the intended purpose, including for error correction. It explores the notions of ‘error’ and ‘necessity’ as defined by the Court of Justice of the Euro-pean Union in its judgment in Top System, CaseC-13/20. The main thesis of the article is that if the policy choice is to incentivize independent repair, upgrades and refurbishment services, the current shape of copyright protection of computer programs in the European Union is an underestimated
