The right to the protection of one’s personal data and the Italian constitutional basis therefor do not allow for territorial restrictions on the sphere of protection in practice, particularly when this right overlaps with and is combined with the rights to identity, privacy and contextualisation of information. 2. EU law does not require Member States to ensure that data subjects who avail themselves of the right to de-indexation can effectively impact all versions, including non-European versions, of the search engine. Nor, however, does EU law prohibit Member States from permitting such an outcome. Ergo, each Member State is free within its own national framework, per national standards of protection of fundamental rights, to balance a data subject’s right to privacy and the protection of his or her personal data against the right to freedom of information and ultimately to require a search engine operator to carry out de-indexation on all versions of its search engine, including non-European versions.
