The boundaries of the public domain have been for centuries difficult to ascertain with certainty and with the emerging of new technologies, including artificial intelligence (AI), the question on the table is whether its scope has widened or tightened. The public domain is dependent on intellectual property (IP) protection. Are AI generated creations protectable under the current IP system? Some legislations deny protection to creations emanating autonomously from a machine or intelligence computer. Is it fair to simply conclude that those creations fall in the public domain? Or should not IP lawyers get out of the box and think about a better system which may accomodate protection of AI generated creations? The author is of the view that creations generated by AI should not automatically be part of the public domain at the outset. It is recommended to provide protection to creations enerated by AI under defined conditions as proposed by the author. In other words, exclusive rights should be provided to the person who has control over the AI and each country would have a leeway to set up components defining "control". It is only if the protection criteria are not met that those unprotectable creations may be a part of the public domain.
