  • This is an article about the recent U.S. Supreme Court decision in Andy Warhol Foundation for the Visual Arts, Inc. v Goldsmith, a case involving the fair use defence. It discusses the Court's holding and reflects on whether, in denying the applicability of the fair use defence, the availability of Section 107 of the U.S. Copyright Act is in fact more limited now than what was the case in the past. The article concludes that fair use is, by its nature, a fact specific doctrine. As a result, each case must be judged on its own merits and the broader teachings of the most recent instalment might be more limited that what some have submitted in the immediate aftermath of the U.S. Supreme Court decision.
