  • The way we consume copyright-protected content has undergone some significant changes during the last decade. However, unauthorised file-sharing online remains a relevant problem. According to s.60a) of the Finnish Copyright Act an author (or their representative) shall be entitled, notwithstanding the confidentiality provisions, to obtain contact information from an intermediary about an internet user who makes unauthorised copyright-protected material available to the public to a significant extent. The settled case law of the Court of Justice of the European Union (CJEU) also requires that a fair balance must be struck between different fundamental rights when the enforcement of copyright is colliding with other fundamental rights. The Finnish Market Court has since 2017 underlined strict interpretation of exceptions to the privacy of individual internet users. However, in 2022, the Finnish Supreme Court (KKO) took a different view on the standard of what constitutes making available to the public to a significant extent. This paper addresses the recent shift in the Finnish case law in the aftermath of the CJEU ruling in Mircom and its ramifications in the context of copyright enforcement.
