On 19 April 2023, Mrs Justice Joanna Smith DBE handed down her decision that Tesco had infringed Lidl's trade mark registrations, passed its goods off as equivalent to Lidl's and infringed the copyright owned by Lidl. Upon review of Tesco's counterclaim, the judge found that several of Lidl's registrations were filed in bad faith in an attempt to "evergreen" them. If this High Court decision is upheld, it will have profound effects on what can attract copyright protection, how evicence is collated within trade mark infringement claims and is a helpful reminder that passing off is not merely confined to misrepresentations as to origin but includes misrepresentations as to equivalence also.
