  • The rise of Generative artificial intelligence (AI) chatbots in online search could herald a sea change in a lucrative market which has been relatively stable for 20 years. However, given the present imperfections of the average AI chatbots and their tendency to make errors or 'hallucinate', it seems that they may mimic the average human consumer in more ways than one. Indeed, trade mark law is built on dealing with imperfection and is the AI chatbot no different to the average human consumer, an actor that trade mark law has been dealing with for decades?
