  • The article discusses the territorial scope of the prohibition against infringement of the European Union trade mark (EUTM) with a reputation. It follows from the Court of Justice of the European Union (CJEU) case law that, when such a prohibition is issued by a court having jurisdiction in respect of the territory of all the Member States, as a rule, it should apply throughout the European Union (EU). The paper establishes that territorial restrictions shall be possible when, in part of the EU, there is no risk of injury to the reputed EUTM due to the perception of the conflicting signs by the public concerned or the defendant proves that it had a due cause legitimising the use of the contested sign. In contrast, the reputation of the EUTM or use of the contested sign established only in part of the EU shall not constitute valid grounds for limiting the scope of the prohibition.
