The film Gangs of Lagos showcased the Eyo masquerade (intangible cultural heritage) in a way the Isale Eko (Lagos Island) Community Descendants found unacceptable. The film is a beautiful and original expression of an idea, nevertheless, due process must be followed in the use of intangible cultural heritage. In Nigeria, the Copyright Act does not directly protect cultural heritage, while expression of folklore is protected as Neighbouring or Related Rights. Trademarks Act does not specifically protect cultural symbols but the common law of passing off seems applicable. The UNESCO Convention Safeguarding Intangible Cultural Heritage promotes conservation of Eyo Masquerade and serves as a guideline for protection. This article identifies the rights of Isale Eko Descendants as the community where intangible cultural heritage and symbols originates from and the film producers as creators to promote development in Nigeria's creative industry. A balance between the rights of communities regarding their intangible cultural heritage and creators in the society is proposed.
