  • The transposition of Directive 2019/790/EU (Directive on copyright and related rights in the Digital Single Market—hereinafter the ‘CDSMD’) into the national law of European Union (EU) Member States has proved to be a time-consuming task. Many EU countries failed to transpose the CDSMD on time (7 June 2021) and Greece was no exception.1 The law transposing the CDSMD into Greek law (L.4996/2022) was voted on 22 November 2022 and subsequently published in the Government Gazette 2 days later. The provisions of the Directive were implemented in the existing Greek Copyright Act (L.2121/1993—GCA) and in the Copyright Collective Management Act (L.4481/2017). The Greek legislature adopted mostly a conservative approach in the transposition, remaining loyal to the wording and legislative technique of the CDSMD. However, in some instances, the Greek transposition deviates from the original text of the Directive or takes advantage of the discretionary powers granted to national legislatures by the Directive.
