The hard copy period of copyright law, from the 16th to the late 20th centuries, saw the development and testing of sophisticated legal tools for protecting products of the mind. Today, we see the regular emergence of new applications in the digital space, which stretch and challenge the philosophies underlining copyright law. Lawyers require a regularly updated glossary of technical terms to engage in any digital copyright query today—even though the mechanics around ownership and licensing have remained largely unchanged iuris originis. Indeed, the most recent edition of Cornish, Llewelyn and Aplin’s leading textbook Intellectual Property reminds us that because ‘copyright arises upon creation of the work, the question of initial ownership is not complicated, as is the case with patents’. However, in a later section of the same text, we are told that copyright law ‘has a highly flexible notion of authorship’. Even if both attributions are well-founded, trouble lies ahead.
