  • After two preliminary sections on historical considerations about graphic narratives (Section II) and fandom as cultural phenomenon and the relevant literature on the intersection between comics and the law (Section III), the paper introduces and discusses the way copyright law synergises with comics (and other forms of art, such as Manga and animation) under four themes: (i) the copyrightable elements in a comic work (Section IV); (ii) the authorship and ownership issues including the ‘work-for-hire’ doctrine, which is popular in the US and clarifies and limits the extent of control the author of works like comics has against other stakeholders – namely publishing companies, involved in bringing the comic to the market (Section V); (iii) the rationale behind high toleration among copyright owners for acts of infringement by third parties through fan-made comics, manga and animation and the fair use issues of fans’ creations (Section VI); (iv) and lastly, the alternative form of intellectual property (IP) protection - i.e. trademarks – potentially available to comic characters which have fallen into the public domain (Section VII). The article takes into consideration laws and court cases in US and Japan.
