Notwithstanding seventy years of precedent, the Supreme Court in Abitron Austria GMBH v Hetronic International, Inc. held that two Lanham Act provisions concerning trademark infringement do not apply to foreign infringing conduct. The court decided that the location of the infringing "use in commerce" provided a clearer standard to evaluate whether extraterritorial application of the statute is permissible.
