  • In Petrella v Metro-Goldwyn-Mayer, Inc, the Supreme Court of the US (SCOTUS) severely limited the application of the defence of laches (generally defined as the unreasonable and prejudicial delay in commencing suit) in copyright infringement actions. The dispute centred around the critically acclaimed motion picture Raging Bull, and pitted the equitable doctrine of laches against a congressionally prescribed statute of limitations. The court, in a holding which could have far reaching effects on the availability and application of equitable defences in a wide range of cases, reversed a lower court’s dismissal of the petitioner’s copyright infringement claims based on the doctrine of laches.
