  • The substantive boundaries of intellectual property are rapidly shifting (if not disintegrating) in the face of the demands of the digital environment and an increasing emphasis on “flexibilities” in multilateral treaty obligations to support social justice, sustainable development and access to information concerns (among others).1 In a recent chapter on flexibilitiesin its online course in Advanced International Copyright and Related Rights,2 WIPO identified over 20 flexibilities in copyright alone, including the scope of the public domain, the test for “originality”, limitations on copyright for purposes of facilitating access to works,such asin the case of disabilities, international exhaustion and enforcement modalities.3 The official recognition of so much flexibility, and in foundational areas of copyright such as originality, is a welcome development. Yet, as the focus on flexibilities becomes more insistent, and across the entire spectrum of intellectual property rights, the need for normative standards to help “map” the new boundaries such “flexibilities” create becomes more pressing.
