Huomautus sisällöstä, tiivistelmä tms. The limitation period for civil actions for copyright infringement is subject to the provisions of Art. 2224 of the Civil Code. Based on this, in the present case, the action was time-barred, even if the infringement was ongoing. 1. According to the judgment under appeal (Douai, 22 September 2022), in 1985 Mr [P], an artist, sculptor and painter who specialised in depictions of horses, at the request of Mr [U], founder of the Musée [4] vivant aux Grandes écuries at [Locality 3], created a work for the museum, entitled ‘Fontaine aux chevaux’ or ‘la Prueva’, consisting of a monumental sculpture representing three horses in a circular half-shell. 2. Several unauthorised reproductions of this work or parts of it have been made by [X] [K], known as [X] [G]. One of these reproductions, the infringing nature of which was determined by an irreversible judgment of the Paris Court of Appeal on 17 December 2008, was exhibited in the gardens of the company le Potager des Princes, which manages botanical gardens and animal parks in [Locality 3], founded by Mr [U].
