  • One of the most intense lobbying efforts ever concerning European legislation has focussed on Article 17 – formerly Article 13 – of Directive 2019/790 of the European Parliament and of the Council of 17th April 2019 on copyright and related rights in the Digital Single Market (DSM). It has to be said that this legislation made an ambitious promise: to bring collaborative platforms back within the scope of enforceability of copyright and related rights, in other words, to limit the conditional lack of liability created by Directive 2000/31 of 18th June 2000 on electronic commerce, known as the E-commerce Directive. The reaction was of an order of magnitude concomitant with this promise, giving rise to an unholy alliance between GAFAM and certain libertarian organizations. The Directive has therefore had a chaotic history and, after more than two and a half years of negotiations, appears to have survived by some “miracle”...
