  • A form of complexity attaches to video games in law, and particularly copyright law: gaming creation is a challenge for lawyers, whether in relation to the different dimensions eligible for protection, the identification of authors or potential characterisations. The most broadly accepted definition of video gaming includes a reference to multimedia creation: “a combination of elements from different genres on the same digital medium [...] including sounds, texts, still or moving images and computer programs, whose structure and access are governed by software that enables interactivity. Video gaming is also defined as having been designed with its own identity, different to the mere combination of elements comprising it. The video game is a particular form of multimedia creation, in that it incorporates different elements, such as script, visual effects, music, software and more. In copyright law, the consequence of this diversity is a form of complexity in two respects.
