  • This article analyses the alternatives proposed on the matter of data ownership, demonstrating that, while patents, copyright, the database right and trade secrets fall short of providing protection for non-personal data, a new proprietary right may not present the adequate means either to achieve the goal of fostering access to and sharing of data. Against this background, we examine the recent Communication on A European strategy for data and highlight the change of paradigm in the European policies that relinquish ownership of data as a prerequisite for access and sharing and instead focus on creating common spaces were data can be shared. As welcome such change may be, in order to successfully increase data access and sharing, the new European strategy needs to be co-ordinated with the EU rules on data already in place.
