This paper considers the current framework for regulating the "morality" of patents in Europe and argues that there should be a mechanism for considering the research ethics underpinning a patent claim when assessing a European patent application. The European research agenda increasingly emphasises the importance of research ethics, but to date the patent system has not engaged with these discussions. We would argue that in a changing Europe such a situation is untenable and that the patent offices must accept reponsibility for research ethics. This is important to ensure compliance with research ethics, but also has the potential to assist patent offices in creating more consistent and meaningful assessments of novel biotechnologies going forwards. It has potential to reinvigorate the patent system itself, ensuring that the European patent system reflects the values of European research community.
