  • The use of and access to copyrighted material in educational settings is obviously relevant when it comes to protecting the fundamental right to education. As is known, such right needs to be balanced against the right of copyright owners, especially publishers. The collision between these two rights has proved even more evident in the digital environment, especially during the Covid-19 pandemic which has changed the norms of learning and accessing educational materials. For example, response to this exceptional global event led to libraries being shut off along with access to their physical books; it also prompted an upsurge of e-learning (“Emergency Remote Teaching” – ERT). In order to accomplish their educational aims in times of pandemic and cope with the ‘platformisation’ of education, academic institutions need to rely on effective and appropriate copyright exceptions and limitations. Without the latter, they would be required to enter into even more digital license agreements to use, and make available to students, all copyrighted content they need in both synchronous and asynchronous sessions (e.g. e- books). This may be difficult and expensive to achieve in light of the existing regimes of (strong) copyright protection. Against this background, this short paper aims to use the case of remote learning during Covid to test, from a copyright perspective, the feasibility of a more generalized shift towards blended education, even beyond and after the pandemic.
