In recent years, hashtags have become a familiar symbol due to their use on different social media platforms such as Twitter, Facebook and Instagram. Internet users use different hashtags to get more visibility and attention to their posts. However, people are unaware that some of the hashtags they use to tag their posts may be registered trademarks. For example, #bestfeelings is a registered trademark used by S.C. Johnson for air fresheners. However, people use this hashtag to tag their posts on social media. In this scenario, such posts with registered trademarks may land users in infringement suits for unauthorized use of a registered trademark. In this commentary piece, we attempted to shed some light on the issue of trademarking hashtags in various jurisdictions, as well as provide a comparative overview of this issue from the standpoint of trademark law in Australia, the UK, the EU, India and the US. We also retrieved data related to registered and unregistered trademark applications directed towards hashtags from trademark register databases in provided jurisdictions. In addition, we have also attempted to assess some significant case law in relation to the infringement of registered hashtag trademarks.
