Database rights in created data have been curtailed by the courts over the past decade. Collected data such as match data, however, remain protectable. The High Court's decision examines three points of particular interest: (a) the subsistence of sui generis database rights in factual match data; (b) infringement through extracting a qualitatively substantial part of database contents; and (c) the potential limits of joint tortfeasorship in relation to international sharing of data between multiple parties.
