  • Expanding the horizons of consumer choice has been one of the primary objectives of the neo-liberal philosophy. In the market, private players guide the hands of concumers in making "informed" choices, assuming the role of conscience-keeper of the society. The moral and legal culpability of copyright infringement has been entrenched in our minds by the constant cacophony in theatres, on the internet, and television and it can be condenced in one word - PIRACY. This article seeks to challenge this well entrenched contemporary notion of digital piracy. The first part of the article tries to locate the exact origins of the rhetoric of piracy in copyright. It analyses the legal appropriateness of interrelating the concept of 'copyright infringement' with various crimes such as sea piracy, and theft. The article argues in favour of 'fair labelling' of copyright infringement which reflects a broader and wider understanding of the magnitude and nature of law breaking. The article also seeks to bring along game theory to explain the case of 'profitable piracy' which flies in the face of claims made by software industry. The article seeks to broaden the academic discourse on copyright infringement by taking into account the unexplored areas of historical, behavioural and legal contexts. It strives to provide a more comprehensive understanding of piracy that is not just limited to its economic dimension.
